  1. PRIMERO. DEJAR SIN EFECTO la providencia del 11 de agosto de 2008, proferida por el Juzgado Doce Penal del Circuito de Cali.
  2. SEGUNDO. ORDENAR al Juzgado Doce Penal del Circuito de Cali, resuelva de fondo la acción de tutela interpuesta por Imelda Redin contra el Director del Departamento Administrativo del Medio Ambiente- DAGMA y otros, conforme a las previsiones del artículo 86 de la Constitución Política y del Decreto 2591 de 1991.
  3. TERCERO. Por Secretaría General COMUNÍQUESE al Juzgado Trece Penal Municipal con Función de Garantías de Cali y al Tribunal Superior del Distrito Judicial de Cali, Sala Penal, con el fin de que tengan conocimiento sobre lo aquí resuelto por la Corte Constitucional en relación con el conflicto de competencia.
